Representatives and Senators Introduce Bipartisan, Bicameral CONSENT Act to Protect Online Users

Representatives Nathaniel Moran and Jennifer McClellan, along with Senators Brian Schatz and Steve Daines, have introduced the bipartisan, bicameral CONSENT Act aimed at protecting Americans from unsolicited lewd photos in online spaces. The bill addresses the rising issue of cyberflashing, which involves the transfer of sexually explicit content without consent through various digital platforms.

In a statement, Congressman Nathaniel Moran emphasized the importance of the CONSENT Act in establishing safeguards to protect privacy and security online. Congresswoman Jennifer McClellan highlighted the concerning increase in online sexual harassment and the exploitation of AI-generated explicit content, stating, "The CONSENT Act will address the privacy and safety concerns of online users and help ensure individuals have legal recourse in these devastating situations."

Senator Brian Schatz, a member of the Senate Committee on Commerce, Science, and Transportation, emphasized the need to prevent sexual harassment and hold perpetrators accountable, stating, "By providing a federal private right of action and imposing penalties, this bill will help prevent sexual harassment and hold perpetrators accountable." Senator Steve Daines echoed this sentiment, emphasizing the importance of holding perpetrators of cyberflashing accountable.

The CONSENT Act includes provisions such as ensuring a private right of action against individuals who send unsolicited explicit images, providing avenues for victims to seek damages and restraining orders, and safeguarding the privacy of minors.

The bill has garnered support from various organizations, including the online dating app Bumble, the National District Attorneys Association, National Organization of Women (NOW), Virginia NOW, and the National Political Women's Caucus. Lidiane Jones, CEO of Bumble, commended the bipartisan effort behind the CONSENT Act, highlighting the importance of protecting users from unsolicited lewd content.

Christian F. Nunes, National President of the National Organization for Women, emphasized the empowering nature of the legislation for victims of cyberflashing, urging Congress to support the bill. Deidre Malone, President of the National Women's Political Caucus, and Nelson Bunn, Executive Director of the National District Attorneys Association, also expressed their support for the CONSENT Act and its role in protecting individuals' privacy and dignity online.

The CONSENT Act represents a significant step towards addressing online harassment and ensuring a safer digital environment for all users.
